Preambular Framework & Constitutional Rights

These Terms of Service govern your interaction with the Nchoko & Company Advocates website, booking channels, and public portals. As an institution bound by national values, our terms observe and support the guarantees of the Constitution of Kenya (2010), specifically:

1. No Legal Practitioner-Client Relationship

Information disseminated on this website or submitted via contact forms does not establish a formal Advocate-Client relationship. Under the Advocates Act (Cap 16, Laws of Kenya) and LSK regulations, an Advocate-Client relationship is only initiated upon:

  1. Completion of a formal conflicts-of-interest assessment by the firm's partners.
  2. Execution of a written Retainer Agreement or Letter of Engagement.
  3. Payment of the required retainer fees as stipulated under the Advocates Remuneration Order.

Violators will be logged via IP signatures, blocked from access, and reported to the National Computer and Cybercrimes Coordination Committee (NC4) under the Computer Misuse and Cybercrimes Act, 2018.

4. Liability and Jurisdiction

The firm maintains this website on an “as is” and “as available” basis. In accordance with Kenyan law, we exclude all warranties to the maximum extent permitted. These terms shall be governed by, construed, and enforced in accordance with the Laws of the Republic of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the Courts of Kenya.
